  • Is it a requirement for non CDL box truck to have an ELD

    Yes, non-CDL box trucks may require an ELD depending on their weight, operation, and whether they meet the criteria for exemptions like the short-haul exception.


    All motor carriers and drivers, including those operating in intrastate commerce, are required to use an ELD to record a driver's RODS, pursuant to Title 13 of the California Code of Regulations (CCR), Section 1213(a)(1), unless otherwise exempted.

  • Did NTA stop offering drug testing?

    It was Nationwide Testing that went out of business. We ended our relationship with them last year when they reneged on our contract.

  • Why are non CDL trucks required at the weigh in stations?

    Non-CDL trucks, including U-Haul trucks and other commercial vehicles, are required to stop at weigh stations to ensure compliance with weight regulations and promote road safety by preventing overloaded vehicles, which can damage infrastructure and pose hazards.

  • Do I need to have a up-to-date Unified Carrier Registration

    That depends on if you have trucks or not. You are only required to have an up-to-date unified carrier registration if you currently have trucks, power units or drivers.

  • Do I need to keep an updated and paid Unified Carrier Registration (UCR)?

    Yes, a freight broker, even if it doesn't own or operate any trucks, is required to file a UCR (Unified Carrier Registration) if it is involved in interstate commerce. Brokers are considered "others" who are engaged in interstate commerce and therefore must register and pay the annual fee

  • If I am missing records of pre-hire drug tests from some long standing employees. Do I have them do another test?

    The answer is NO.

     

    First of all, let’s NOT worry about the chain of custody. What you need is the actual “Hard Copy” of the results signed by the MRO in their DQ files.

     

    As far as doing some pre-employment testing now, this will not do you any good as the ship has already sailed.

     

    If these errors did not occur during your employment (they occurred after you took over). There may be a way out.

     

    Presuming that you have some Random drug and/or alcohol tests with negative results in their applicable files. You must make a note in the applicable DQ files explaining these circumstances and the dates these errors were found.

     

    Your argument and/or salvation may rely on the fact that a Random test may be considered a Pre-employment test, as the person does not know when they will be tested. But on the other hand, a Pre-employment test can not be considered a random test as the person already knows he will be required to take a test.

     

    Hopefully, you have a good SMS score in place, as this situation may be missed during an audit, but not during discovery from a vehicle accident.

  • Is a non-CDL truck required to file IFTA quarterly? 

    It depends on the gross vehicle weight of the unit. As long as your maximum operating gross weight does not exceed 26,000 lbs., there is no requirement to have an IFTA sticker or IRP plates. You may, however, need to obtain commercial license plates from your own state of Texas.
